Struck by a Car in Tampa? Understand Your Right of Way and Legal Options

Reviewed by Bobby Jones, Personal Injury Attorney, Jones Law Group | Published | Updated .

Getting struck by a vehicle while you’re on foot can leave you with broken bones, a head injury, and medical bills stacking up before you’ve even left the hospital. If you were hit while crossing one of Tampa’s wide, high-speed arterials like Nebraska Avenue or Florida Avenue, or while walking through the crowded nightlife blocks of Ybor City, a Tampa pedestrian accident lawyer at Jones Law Group can help you sort out who is legally responsible and how to get your medical bills and lost income covered. Attorney Bobby Jones and the Jones Law Group team have spent years representing injured pedestrians throughout the Tampa Bay area, and every pedestrian accident case is handled on contingency, so there’s no upfront cost and no fee unless we recover money for you.

Almost as soon as a pedestrian crash is reported, the driver’s insurance adjuster starts looking for a way to shift blame onto the person who got hit. In Tampa, that usually means combing the police report for any excuse to argue the pedestrian was “jaywalking” or wasn’t inside a marked crosswalk, even in situations where Florida law plainly puts the pedestrian in the right. On arterials like Nebraska Avenue and Florida Avenue, where marked crosswalks can be spaced a quarter mile or more apart, that tactic gets used constantly, because adjusters know most people don’t realize an unmarked crosswalk still counts under the law. Understanding how Fla. Stat. § 316.130 actually works is the first step in pushing back against that strategy.

Who has the right of way? Florida’s pedestrian crossing law

Under Fla. Stat. § 316.130, a pedestrian crossing a roadway within a marked crosswalk or within an unmarked crosswalk at an intersection has the right of way, and the driver must yield. A marked crosswalk is a crossing area that’s painted or signed at an intersection or mid-block location. An unmarked crosswalk is the legal extension of a sidewalk across an intersection — it exists whether or not the pavement has paint, as long as the intersection connects two sidewalks. That distinction matters enormously in Tampa, where a lot of older intersections in neighborhoods like Tampa Heights and Seminole Heights were never repainted with crosswalk lines, even though the legal crossing zone is still there.

The statute does place some responsibilities on pedestrians too. A person may not suddenly leave a curb or other place of safety and walk into the path of a vehicle so close that the driver can’t reasonably stop, and pedestrians crossing outside of any crosswalk must yield to vehicles already on the roadway. But “outside a crosswalk” is a much narrower category than most insurance adjusters claim, and it doesn’t erase a driver’s separate duty to keep a proper lookout and exercise due care for pedestrians already lawfully in the roadway. Even when a pedestrian is found partly at fault, Florida’s comparative negligence system, updated by HB 837 in 2023, reduces — but doesn’t automatically eliminate — a claim, unless the injured person is found more than 50% responsible for the crash.

Right of Way at a Tampa Crosswalk Fla. Stat. § 316.130 puts the pedestrian in the right — but insurers still fight over positioning Pedestrian has the right of way Crossing in a marked crosswalk, e.g. at Nebraska Ave & Palm Ave Crossing in an unmarked crosswalk that extends a sidewalk across a street Crossing with the Walk signal at a signalized downtown intersection Already lawfully in the roadway when a vehicle turns across their path A driver still must yield even if the crosswalk has no paint at all Driver still at fault despite blame tactics Claiming the victim “jaywalked” despite being in a legal crossing zone Pointing to long gaps between marked crossings on Nebraska Ave or Florida Ave Alleging the pedestrian “darted out” from between cars in a crowded Ybor City block Arguing partial fault to try to trigger Florida’s comparative negligence bar None of these tactics override a driver’s duty to keep a proper lookout for people Bottom line: right of way doesn’t disappear because a crosswalk is unmarked or far apart — but proving it takes documentation from the scene. Florida’s right-of-way rule under Fla. Stat. § 316.130 favors pedestrians in Tampa crosswalks, marked or unmarked — insurers just don’t always tell you that.

How Tampa pedestrian crashes happen

Most of the pedestrian crashes our firm sees in Tampa trace back to a handful of repeating conditions in the roadway design and the surrounding foot traffic. Nebraska Avenue, Florida Avenue, and Armenia Avenue are wide, high-speed north-south arterials that cut directly through dense residential pedestrian corridors near Tampa Heights and Seminole Heights, yet their marked crossings are often spaced far enough apart that people on foot are forced to choose between a long detour and a shorter, riskier crossing. Drivers moving at arterial speeds are frequently not looking for someone stepping off a median or finishing a crossing across several lanes of traffic.

Ybor City presents a different hazard: heavy nightlife foot traffic mixing with vehicle and rideshare traffic on narrow, brick-paved streets, especially after dark on weekend nights, when visibility is poor and both drivers and pedestrians are more likely to be distracted. Downtown, the Channelside/Water Street district and the Riverwalk draw heavy foot traffic across vehicle crossings connecting the entertainment district, arena, and office towers, and pedestrian-vehicle conflicts happen at driveways and side streets that lack a dedicated signal phase for people on foot. Poor lighting, wide turning radii, and long gaps between marked crosswalks are recurring themes in nearly every serious pedestrian claim our firm has handled in the city — and they’re a large part of why Florida is consistently ranked among the most dangerous states in the country for pedestrians.

Injuries and where Tampa pedestrian victims are treated

Pedestrian crashes tend to produce more severe injuries than typical car-on-car collisions, because a person’s body absorbs the impact directly instead of being cushioned by a vehicle frame. Traumatic brain injuries, spinal cord damage, pelvic and femur fractures, and severe soft-tissue degloving injuries are common outcomes even at moderate vehicle speeds. Tampa General Hospital on Davis Islands is Tampa Bay’s only ACS-verified Level I trauma center for both adults and children, and it’s where many of the most seriously injured pedestrians from crashes on Nebraska Avenue, in Ybor City, or downtown near the Riverwalk are taken by ambulance. St. Joseph’s Hospital, part of BayCare, operates as a Level II adult and pediatric trauma center and also treats a substantial share of Hillsborough County’s pedestrian trauma patients.

The hospital and trauma records generated at Tampa General or St. Joseph’s aren’t just medical documentation — they’re often central evidence in the claim, establishing the mechanism of injury, the emergency treatment provided, and the long-term prognosis an insurance adjuster will be asked to pay for. Gaps in treatment or inconsistent symptom reporting give adjusters an opening to argue an injury isn’t as serious as it is, which is one more reason to keep every follow-up appointment after a pedestrian crash.

What is my Tampa pedestrian accident claim worth?

There’s no fixed dollar figure that applies to every pedestrian accident claim, because the value depends on the severity of the injury, the amount of past and future medical treatment, lost income, and how strongly the evidence supports the pedestrian’s right of way at the time of the crash. Damages in a Tampa pedestrian accident case typically fall into a few categories: past and future medical expenses, lost wages and diminished future earning capacity, pain and suffering, and, in catastrophic cases, the cost of long-term care or permanent disability accommodations.

Comparative negligence has an outsized effect on pedestrian claims specifically, because insurers so often argue the pedestrian shares fault for the crossing location or timing. If an adjuster or jury assigns you, say, 20% of the fault for a crash, your recovery is reduced by that percentage — and under Florida’s modified comparative negligence rule, if you’re found more than 50% at fault, you may be barred from recovering anything at all. That’s exactly why documenting where you were crossing, what signal was showing, and what the driver was doing matters so much in these cases. Frequently asked questions

Does a pedestrian always have the right of way in Tampa?

In most crossing situations, yes. Under Fla. Stat. section 316.130, a pedestrian crossing within a marked crosswalk or within an unmarked crosswalk at an intersection has the right of way, and the driver must yield. Drivers also owe pedestrians a general duty of care even when they are outside a crosswalk.

Can I still recover damages if I wasn’t in a marked crosswalk?

Often, yes. Florida law recognizes unmarked crosswalks, which are the legal extension of a sidewalk across an intersection, even where there is no painted crosswalk. In addition, a pedestrian who was outside any crosswalk can still recover damages under Florida’s comparative negligence rule, as long as they are not found more than 50% at fault for the crash.

What if the insurance company says I was jaywalking?

Insurance adjusters commonly claim a pedestrian was jaywalking to reduce or deny a claim, especially on wide arterials like Nebraska Avenue and Florida Avenue where marked crosswalks are spaced far apart. A pedestrian accident lawyer can review the police report, witness statements, and roadway layout to determine whether that characterization is accurate or is being used purely as a negotiating tactic.

How long do I have to file a pedestrian accident claim in Florida?

In most cases, Florida’s statute of limitations gives an injured pedestrian two years from the date of the crash to file a personal injury lawsuit, under Fla. Stat. section 95.11 as amended by House Bill 837 in 2023. Missing that deadline generally bars the claim entirely, so it is important to speak with an attorney well before the deadline approaches.

How does comparative negligence affect my pedestrian accident claim?

Florida uses a modified comparative negligence system. If you are found partially at fault for a pedestrian crash, your compensation is reduced by your percentage of fault, and if you are found more than 50% at fault, you may be barred from recovering damages at all. This is why insurers focus so heavily on crosswalk positioning and right-of-way arguments in pedestrian cases.

Where are Tampa pedestrian accident lawsuits filed?

Pedestrian accident lawsuits arising from crashes in Hillsborough County, including Tampa, are typically filed in the Thirteenth Judicial Circuit of Florida at the George E. Edgecomb Courthouse, located at 800 E. Twiggs St., Tampa, FL 33602.
